Terms & Conditions / Waiver

1. Safety & Conduct

1.1. All guests must follow the instructions provided by the captain and crew at all times.
1.2. Life jackets and safety equipment are provided and must be used when instructed.
1.3. The company reserves the right to refuse service or remove any guest behaving in a disruptive or unsafe manner, with no refund provided.
1.4. Alcohol consumption is permitted but must be consumed responsibly.

2. Weather Policy

2.1. Tours are subject to weather conditions. Safety is our top priority, and we reserve the right to cancel or delay tours if conditions are deemed unsafe.
2.2. In the case of cancellation due to weather, customers will be offered a reschedule or a refund.

3. Liability & Assumption of Risk

3.1. Guests participate in tours at their own risk. While we take all necessary precautions, we are not responsible for any injuries, losses, or damages incurred during the tour or as a result of the tour and all (other) services provided by us. By accepting these (security) conditions you expressly waive all (future) rights to claim any compensation from us for any damage/costs you have suffered/incurred and you agree to indemnify and hold us harmless from and against possible claims by third parties in any way related to the boat trip and/or one of our (other) services.
3.2. By booking a tour, guests acknowledge the inherent risks associated with water activities, including but not limited to boat movement, marine life, and weather conditions.

4. Age & Health Requirements

4.1. Some tours may have age restrictions for safety reasons.
4.2. Pregnant individuals, those with pre-existing medical conditions, or individuals with mobility issues should consult with us before booking.

5. Private Charters

5.1. Private charters include a dedicated captain and crew unless otherwise specified.
5.2. The renter is responsible for any damages caused to the vessel during the charter.

6. Photography & Media

6.1. We may take photos or videos during tours for promotional purposes.
6.2. If you do not wish to be photographed, please inform our crew before the tour.

7. Governing Law

7.1. The Curaçao law fully applies to these (security) conditions and to all our services, with exclusive jurisdiction for the Court of First Instance and the Court of Appeal of Curacao.
